The list is very long, and growing. All of the above legislation require a specific health risk assessment for certain hazards and tasks, and in individuals with relevant medical problems. It is obligatory to do an assessment if a person is subject to a hazard at work, and even if they are not subject to a hazard but they declare a medical problem (eg certain medical conditions make driving hazardous.) This need not just be a paper exercise – in certain instances, risk assessments are extremely valuable. Some employees can be a threat to themselves, other employees and your business interests. It is a jailable offence if a failure to carry out an assessment causes death or injury to employees, customers, or the general public, and employers face both criminal and civil liability.
